Thank you for visiting the OXZGEN™ website located at www.OXZGEN.com (the "Site"). The Site is an Internet property of Oxzgen, Inc. and OXZGEN Nutritional Supplements, Ltd. ("OXZGEN™," "we" or "us").

The following OXZGEN™ Website Terms and Conditions ("Terms and Conditions") hereby expressly incorporate by reference the OXZGEN™ Privacy Policy ("Privacy Policy"), other operating rules, policies, price schedules and other supplemental terms and conditions or documents that may be published from time to time (collectively, the "Agreement"). Please review the complete terms of the Agreement carefully. By using, accessing and/or purchasing OXZGEN™ products (collectively, "OXZGEN™ Offerings"), you agree to comply with and be bound by the Agreement in its entirety. If you do not agree to the Agreement in its entirety, you are not authorized to use OXZGEN™ Offerings in any manner or form.

Unless explicitly stated otherwise, any future offer(s) made available to you on the Site that augment(s) or otherwise enhance(s) the current features of the OXZGEN™ Offerings shall be subject to the Agreement. You understand and agree that OXZGEN™ shall not be liable to you or any third party for any modification, suspension or discontinuation of any OXZGEN™ Offerings, product, service or promotion offered by OXZGEN™ or any OXZGEN™ Third Party Providers. You understand and agree that refusal to use the OXZGEN™ Offerings is your sole right and remedy with respect to any dispute with OXZGEN™.

Shipping Policy

OXZGEN products are only available in the United States and the Virgin Islands. Orders process within 24-48 hours of receipt.  The average transit time is 5-7 business days unless expedited and may vary based on location.  Shipments outside the 48 contiguous United States may experience longer transit times.

Once the carrier shows the order has been successfully delivered, it is considered fulfilled and complete.  OXZGEN is not responsible for lost or stolen items and will not provide replacements.

Returns and Refund Policy

Products can be returned within 15 days of the order date.  Returned product must be unopened, unused, and in a resalable condition.  Returns can be initiated through any of the following methods:

Product(s) must be returned to OXZGEN at the address below.  Refunds will be issued, minus shipping & handling and a 25% Restocking Fee, once the product has been received by OXZGEN and has cleared the inspection process.  Eligible refunds will be made to the billing method used for the original purchase and will be authorized within 15 days of receipt of the returned product by OXZGEN.

Cancellation Policy

To cancel your OXZGEN subscription, you must call OXZGEN Support at 1-844-5-OXZGEN (1-844-569-9436) at least 10 days prior to your next subscription shipment date.

A new order can be placed online but is subject to the promotions and rules in place at that time.

Please note:  This OXZGEN Returns and Refund Policy supersedes E.P.I.C. or any other Vendor, Client Policy.  For E.P.I.C Representatives, once you have earned commission on a product, and are outside of the 15-day Return Period, you are no longer eligible for a cash refund and will receive store credit.

Process for Return

In order for a product return to be processed efficiently, we request that you:

  1. Initiate return for a refund by email or phone.
  2. Provide your original order number and reason for return.
  3. On the outside of the return shipment box, clearly print the original order number in indelible ink.  Packages without visible order numbers may be rejected by OXZGEN & returned.

  1. You are responsible for prepaying all shipping costs related to the returned items.  OXZGEN do not accept collect packages.
  2. You are encouraged to add a prepaid tracking or delivery confirmation service to all return packages.  If the returned product is not received by OXZGEN, it is your responsibility to trace the shipment.

Damaged or Incorrect Product Policy

If the product you received is incorrect or damaged, you must notify OXZGEN within 72 hours of receipt the shipment.  We require a picture of the incorrect or damaged order and a copy of the invoice that was included in your package. Once all documentation has been received and confirmed by OXZGEN to be unopened, unused, & resalable, your replacement items will be sent within 15 days.  You may be required to return the damaged order.  We may request the return of any item prior to replacing it.

OXZGEN will honor the exchange if the product is damaged or incorrect due to OXZGEN error.

If an order is returned and OXZGEN determines the product is not damaged nor fulfilled in error, the customer is responsible for all return shipping charges and/or a 25% Restocking Fee.

Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the country in which the merchant is located.

SUBSCRIPTION AGREEMENT TERMS AND CONDITIONS

The OXZGEN Subscription Program (the “Program”) is an optional program under which a customer places a continuing product order to be charged against his/her Credit Card. By agreeing to these terms, customer desiring to participate in the Program agrees to the following terms and conditions:

I understand and agree that the products selected on this Program agreement will be charged to my Credit Card and sent to me at the address provided each and every month as I have indicated. I understand that my Credit Card will be charged 4 days prior to my next Subscription date. I understand that I may cancel my Subscription at any time without incurring any penalties or fees. Any cancellation or changes I wish to make to my Subscription order must be made by calling OXZGEN Support at 1-844-5-OXZGEN (1-844-569-9436) or emailing OXZGEN Support at [email protected] at least 10 days prior to my next Subscription shipment date in order to be processed in time to stop or change my next Subscription order. By clicking the “I agree” button, I am acknowledging the terms explained in this Program agreement and authorize OXZGEN to establish an automatic Credit Card payment arrangement as specified in this Program agreement to pay for each monthly Subscription order. OXZGEN will make no other charges to my Credit Card account except for those that I have authorized. I understand that my participation in the Program will continue until cancelled.

If any problems arise with my shipping address or the Credit Card provided on this Program agreement, I understand that my participation in the Program will be placed on hold and no additional products will be processed or shipped until the problem has been resolved.

I acknowledge that these terms and conditions are between me and OXZGEN, and govern our rights and obligations. I acknowledge that OXZGEN may, in its sole discretion, change these terms and conditions at any time without prior notice to me. MY CONTINUED PARTICIPATION IN THE PROGRAM AFTER THE TERMS AND CONDITIONS ARE CHANGED CONSTITUTES MY ACCEPTANCE OF THE CHANGES. IF I DO NOT AGREE TO THE CHANGES, I MUST CANCEL MY PARTICIPATION IN THE PROGRAM.

I acknowledge that OXZGEN may, in its sole discretion, terminate my participation in the Program at any time and may discontinue or modify the Program or the products available through the Program at any time. If OXZGEN terminates my participation in the Program, I will only be charged for orders that have shipped to me.

LIMITATION OF LIABILITY: IN NO EVENT WILL OXZGEN OR ANY OF ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO MY PARTICIPATION IN THE PROGRAM. OXZGEN’S TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE WILL NOT EXCEED THE AMOUNT OF. ALL PAYMENTS ACTUALLY MADE BY ME DURING MY PARTICIPATION IN THE PROGRAM. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE ANY CANCELLATION OR TERMINATION OF MY PARTICIPATION IN THE PROGRAM. IF ANY PROVISION HEREOF IS FOUND TO BE INVALID, IN WHOLE OR IN PART, IT WILL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHER PROVISION HEREOF. THIS AGREEMENT WILL BE GOVERNED AND CONSTRUED UNDER THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO CONFLICT OF LAWS PRINCIPLES.
